Dear Naturist,

This is an Update from the Naturist Action Committee. NAC is making you aware of recent developments, favorable and unfavorable, that are part of a serious threat in the state of California.

A VERY BRIEF SUMMARY OF THE SITUATION

As detailed in the NAC Action Alert of May 21, 2008, Ruth Coleman, Director of California’s Department of Parks and Recreation, has abruptly terminated the Department’s application of the Cahill Policy to clothing-optional portions of San Onofre State Beach in San Diego County. The Cahill Policy has been used successfully for decades as a management tool for clothing-optional areas within California State Parks.

The specious justification being given by CA Parks for the selective revocation of Cahill at San Onofre State Beach is that doing so will eliminate illicit sexual activity that occurs primarily on an adjacent military beach. The recision of the Cahill Policy would pave the way for park rangers to issue citations for simple nudity on the State Beach under Title 14, Section 4322 of the California Code of Regulations.

NAC Action Alert - San Onofre State Beach, California

This is an Action Alert from the Naturist Action Committee. NAC is asking for your immediate help in responding to a serious threat in the state of California.

NAC has learned that Ruth Coleman, Director of California’s Department of Parks and Recreation, has abruptly revoked the application of the Department’s Cahill Policy, as it applies to clothing-optional portions of San Onofre State Beach in San Diego County. Rangers have been told to begin “educating” beachgoers, starting June 1. The issuing of citations for nudity in the traditional clothing-optional area is to follow after 30 days.

NAC ADVISORY - Lake Willoughby - Westmore, Vermont

In Westmore, VT, a clothing-optional beach on Willoughby Lake had been threatened by a petition to ban nudity in that town. However, the petition had to be withdrawn due to improper wording and submission, and is no longer a direct threat. The Westmore Selectboard has decided to hold a moderated public hearing on the issue and receive written public comments, but is not planning any action at this time. Friends of Willoughby, a local users group, has planned specific action steps, including a clean-up of a clothed beach on Willoughby Lake, as a community service and good-faith gesture towards the town.

NAC ADVISORY - Florida House Bill 801

Section 800.03 of the Florida Statutes addresses the exposure or exhibition of sexual organs in a public place. Based on the existing wording of the law, 800.03 has been held by Florida Courts to make such exposure illegal only when it is done in a lewd manner.

House Bill 801 proposes changes to the wording of 800.03 that could jeopardize the protection for naturists afforded by current judicial rulings. Moreover, the bill seeks to add increased penalties under 800.03 in certain locations and during certain times of day. Nudity within 1,000 feet of a “state, county, or municipal park” or “a public beach” would be an automatic felony at any time. The legislation poses an obvious and severe threat to naturists at clothing-optional Florida beaches like Haulover, which is a public beach located within a county park. Other Florida sites would be at similar risk.

SUBJECT: NAC files as amicus in Ohio topfree appeal

Dear Naturist,

The Naturist Action Committee has filed a legal memorandum with the Ohio Supreme Court in an appeal by a woman who was arrested and convicted for being topfree in a city park. NAC is acting as an amicus curiae, or “friend of the court,” and its document supports the Court’s acceptance of jurisdiction.

The woman, Lorien D. Bourne, is represented in her appeal by the Ohio chapter of the American Civil Liberties Union, which has filed a separate memorandum in support of jurisdiction. The Ohio Supreme Court is not obligated to accept the case, so the documents at this stage are intended to persuade the Court to recognize the importance of the case, and to take it under review.

Dear Naturist,

This is an Update from the Naturist Action Committee concerning
Brattleboro, Vermont.

BRIEF HISTORY AND DISCUSSION

After receiving complaints from town residents and business owners
concerning public nudity, Brattleboro’s Selectboard adopted an
“emergency” temporary ordinance that prohibits nudity in the downtown
area, in the town park, in the village of West Brattleboro, and also
within 250 feet of a school or place of worship. The Selectboard enacted
this ordinance by a margin of 3 to 2 and considered making this ordinance
permanent at their meeting on the evening of Aug. 21.

At the meeting, Brattleboro residents spoke in favor and in opposition to
the ordinance, and the Selectboard debated the issue at length. One
Selectboard member proposed an amendment to the ordinance, removing all
references to buttocks and breasts, which passed by a vote of 3-2. In an
ironic twist, the Selectboard member who sponsored the ordinance refused
to vote in favor of making the amended ordinance permanent. As a result,
the ordinance failed to pass, 2-3.

While this outcome may seem to be a victory for naturists and proponents
of personal freedom, the decision is not final. The temporary ordinance
banning public nudity is still in effect, and will not expire for another
month. At that time, the Selectboard may reconsider the ordinance and
decide whether or not to make it permanent.

Dear Naturist,

This is an Advisory from the Naturist Action Committee concerning
Brattleboro, Vermont.

BRIEF HISTORY AND DISCUSSION

During a heat wave last summer, the town of Brattleboro received national
media scrutiny for a local group of teenagers who liked to congregate
while partially or fully naked in a downtown parking lot. At the time,
Brattleboro’s Selectboard chose not to act, with the belief that the
nudity would cease when the chilly autumn weather arrived, which did
happen.

On July 6 of this year, a 68-year-old man walked through the downtown
area wearing only sandals and a fanny pack. The man told a reporter from
the local paper that he had planned his vacation in order to visit
Brattleboro because he had learned about their leniency towards public
nudity through the Internet. This happened to coincide with Brattleboro’s
Gallery Walk, a popular monthly event that business owners consider a
draw for tourists and their dollars.

After receiving many complaints from town residents and business owners,
Brattleboro’s Selectboard wrote an “emergency” temporary ordinance that
prohibits nudity in the downtown area, in the town park, in the village
of West Brattleboro, and also within 250 feet of a school or place of
worship. The Selectboard enacted this ordinance by a margin of 3 to 2 and
will consider making this ordinance permanent at their meeting on
Tuesday, August 7, 2007.
