City Drops Obscenity Case
A display ad for clothing brand Abercrombie & Fitch caused a stir in Virginia Beach this month after authorities confiscated two display photos from a clothing store and cited the manager on a misdemeanor obscenity charge. One photograph showed three shirtless young men with one of the men’s upper buttocks showing. The other image was of a woman whose arm covered her naked breast. Police issued the summons after customers at the Lynnhaven Mall complained. The manager of the store was charged because there is no legal way to issue a summons to a corporation under such circumstances. City officials later dropped the charge after it was determined that it would be difficult to meet the standards of the law which states that the display had to “appeal to prurient interests, lack redeeming artistic merit and be offensive to prevailing community standards.” Read more at Obscenity case.

Naked Cowboy Sues Naked M&M
The Wall Street Journal Law Blog reports that Robert Burck, who bills himself as the Naked Cowboy, is suing Mars, Inc. for $6 million over an animated M&M that resembles him. The Naked Cowboy, a well-known fixture in Times Square, strolls through the streets wearing only his underwear, a cowboy hat and boots strumming a guitar. The animated M&M is also dressed in a cowboy hat, boots and briefs in part of a five-minute video that features the candy in New York street scenes and as popular New York icons such as King Kong and the Statue of Liberty.
